5. Marketing & CRM (Mautic)
We use Mautic, an open-source marketing automation tool, for lead management and user behavior
analysis. Mautic sets cookies and collects the following data:
IP address (anonymized)
Visited pages and duration
Device information (browser, operating system)
Form interactions
Legal Basis: Art. 6 para. 1 lit. a GDPR (consent) and Art. 31 para. 2 lit. a
DSG. Storage Duration: Mautic cookies are deleted after 30 days. Withdrawal: You can withdraw your consent at any time in the cookie settings.

We use SSL/TLS encryption for data transmission. Which service providers process data, and in

Terms & Conditions
§ 1 Scope of Application
These General Terms and Conditions (T&C) apply to all contracts and services between
Beherzig (hereinafter "Beherzig") and its clients (hereinafter
"Client").
Deviating conditions of the Client are only recognized if Beherzig expressly agrees to them in
writing.
§ 2 Conclusion of Contract
A contract is concluded by written order confirmation or by commencement of service provision.
Offers from Beherzig are subject to change unless expressly marked as binding.
Consultation Appointments: Arranging consultation appointments via the contact
form does not constitute a binding contract offer. The contract is only concluded through
written confirmation by Beherzig.
Valuation Orders: For property valuations, the contract is concluded upon order
placement by the Client and acceptance by Beherzig.
§ 3 Scope of Services
Off-Market Sales
Beherzig mediates luxury properties discreetly through off-market procedures. Services include:
Market analysis and price valuation
Identification of qualified buyers
Organization and accompaniment of viewings
Negotiation management until purchase contract conclusion
Discretion: Beherzig commits to absolute confidentiality. Property data is only
shared with verified and qualified interested parties.
Property Valuation
Beherzig provides professional property valuations using recognized valuation methods (comparative
value, income value, or asset value method). The valuation serves as a decision basis but does
not constitute a guarantee for an achievable sales price.
Consulting Services
Beherzig offers comprehensive consulting on real estate investments, portfolio optimization, and
relocation services. The scope of consulting is individually agreed upon.
§ 4 Compensation & Commission
Mediation Commission
The commission for the mediation of purchase contracts is based on market rates and is
individually agreed upon. The commission is due upon conclusion of the notarized purchase
contract.
Payment Terms: The commission is due for payment within 14 days of invoicing.
Valuation Fees
Fees for property valuations are agreed upon based on effort or as a flat fee. Cost estimates
are provided in advance based on property information.
Consulting Fees
Consulting services are billed on an hourly basis or as a flat fee. Billing is done according to
written agreement.
§ 5 Client Obligations
The Client undertakes to:
Provide complete and truthful information about the property
Provide relevant documents (land register extract, plans, energy certificate)
Inform Beherzig about legal or structural defects
Enable viewing appointments
Not grant parallel mediation orders to third parties during the contract term (for exclusive
contracts)
§ 6 Liability
Beherzig is liable according to the provisions of Swiss Obligationenrecht (OR). Liability is limited
to intent and gross negligence.
Disclaimer: Beherzig assumes no warranty for the accuracy of third-party information
(e.g., sellers, authorities). For property valuations, no liability is assumed for future market
developments or unforeseeable depreciation.
Limitation of Liability: Liability is limited to the amount of the agreed
commission or fee, to the extent legally permissible.
§ 7 Confidentiality & Data Protection
Beherzig commits to strict confidentiality of all client data and property information. The
processing of personal data is carried out in accordance with the Swiss Data Protection Act
(DSG) and GDPR. Further information can be found in our privacy policy.
§ 8 Contract Duration & Termination
The contract duration is individually agreed upon. For exclusive contracts, the minimum term is
6 months, unless otherwise agreed.
Ordinary Termination: The contract can be terminated with 3 months' notice to
the end of the month.
Extraordinary Termination: The right to terminate without notice for good cause
remains unaffected. Good cause exists in particular in case of:
Serious breaches of duty
Payment default despite reminder
Breach of confidentiality
§ 9 Jurisdiction & Applicable Law
For all disputes arising from or in connection with these T&C, Swiss law applies excluding the
UN Convention on Contracts for the International Sale of Goods (CISG).
Jurisdiction: Exclusive jurisdiction for all disputes is Zug, Switzerland,
provided the Client is a merchant or has no general place of jurisdiction in Switzerland.
§ 10 Severability Clause
Should individual provisions of these T&C be or become invalid or unenforceable, this does not
affect the validity of the remaining provisions. In place of the invalid provision, a valid
provision shall apply that comes closest to the economic purpose of the invalid provision.
